This agreement is made electronically between MBD Travel, operated by M B D TOURISM L.L.C under Dubai commercial licence number 1203162 issued by the Department of Economy and Tourism (“MBD Travel”, “we”), and the person making a booking through the Website (“Customer”, “you”) for the sale of, or arrangement of the sale of, the travel service identified in the order summary.
The product page, pre-contract information, order summary, payment record, booking confirmation and product-specific supplier rules form an integral part of this agreement. By confirming the order, the Customer declares that these documents were available before payment and accepts them.
1. Seller, service and formation
1.1 The seller or intermediary service provider is M B D TOURISM L.L.C, established in the Emirate of Dubai, United Arab Emirates, under Dubai commercial licence number 1203162. Its current address and contact details appear above this document, on the Support page and in the Website footer.
1.2 The order summary states the service type, dates, passenger details, scope, total price, currency, taxes and product-specific conditions.
1.3 Taking payment alone does not constitute supplier confirmation. A booking becomes final when MBD Travel sends written booking confirmation. If supplier confirmation cannot be obtained, the Customer will be offered a suitable alternative; if it is declined, the amount collected will be refunded to the original payment method.
2. Price and payment
2.1 The final amount and currency are shown at checkout. Currency conversion, foreign transaction or similar bank charges are not collected or controlled by MBD Travel.
2.2 If an obvious typing, system or supplier pricing error is found before booking confirmation, the correct price will be disclosed. If the Customer declines it, the order will not be formed and any amount collected will be refunded.
2.3 The Customer confirms that they are authorised to use the card or payment method and that the billing details supplied are accurate.
3. Cancellation, amendment and refund of confirmed bookings
3.1 Where the order summary marks a fixed-date flight, accommodation, tour, activity, transfer or other travel service as “non-refundable”, “non-cancellable” or “non-changeable”, no Customer-requested cancellation, name or date change, or refund for an unused service is available after booking confirmation. Supplier capacity is reserved for the Customer and binding costs arise; illness, a change of plans, late arrival, a missed flight or failure to attend does not by itself disapply this rule.
3.2 If the Customer expressly selects a flexible or refundable rate, only the deadlines, deductions and amendment rules stated for that rate apply. Unless written flexibility is stated, the booking is non-refundable.
3.3 This agreement does not grant an unconditional general cooling-off period for every Customer-requested cancellation. Cancellation and amendment rights are determined by the rate class shown before payment and the mandatory laws of the United Arab Emirates.
3.4 This non-refund rule does not remove any right to repeat performance, price reduction, compensation or refund arising under mandatory UAE law where the service is not supplied, is defective or differs from what was agreed, or MBD Travel breaches its obligations.
4. Mandatory rights under UAE consumer law
4.1 Under UAE Federal Law No. 15 of 2020 on Consumer Protection, where a service is defective MBD Travel will, to the extent applicable to the circumstances, re-provide the service without charge or provide another remedy required by law.
4.2 Under UAE Cabinet Resolution No. 66 of 2023, no term applies if it waives the Customer’s statutory rights, excludes MBD Travel’s liability for breach, or improperly restricts the Customer’s compensation or refund rights.
4.3 Where the Customer cancels solely as a matter of preference and there is no defect or failure of performance described in this clause, the non-refundable rate rule in Clause 3 remains effective.
5. Extraordinary general cancellation by a supplier
5.1 If an airline, hotel, tour operator or other principal supplier cancels the relevant flight, property, tour or the entire booking generally due to an extraordinary event and the service becomes unavailable, MBD Travel will offer an equivalent alternative where reasonably possible.
5.2 If the Customer declines the alternative or no reasonable alternative can be offered, the amount collected by MBD Travel for the cancelled booking will be refunded to the original payment method. Unless mandatory law requires a shorter period, the refund will be initiated no later than fourteen days after the cancellation becomes final.
5.3 A change or cancellation of only one part of an itinerary does not automatically constitute general cancellation of the entire booking. An equivalent service, price reduction or partial refund for the affected part will be determined by the order scope, supplier rule and mandatory law.
6. Force majeure and unavoidable events
War, terrorism, epidemic, natural disaster, border closure, official action, strike, closure of a transport system and similar events outside the parties’ reasonable control do not remove rights under mandatory law. MBD Travel will disclose the available solution, the amount recoverable from the supplier and any documented non-recoverable cost.
7. Customer obligations
7.1 The Customer must ensure that names, dates of birth, passport details, contact details and passenger information are complete and match the travel document. The Customer is responsible for reissue costs, refusal or denial of service caused by incorrect information.
7.2 The Customer is responsible for meeting passport validity, visa, transit visa, health, vaccination, entry and customs requirements in time. General information from MBD Travel is not a decision or guarantee by a competent authority.
7.3 The Customer must check names, dates and service scope promptly after receiving confirmation and report any error in writing without delay.
8. Performance, suppliers and liability
8.1 Transport, accommodation and activity services are performed by their respective suppliers. MBD Travel will perform its own organisation and intermediary duties with due care and does not exclude liability imposed by mandatory law.
8.2 The Customer must report a lack of conformity arising during the service to MBD Travel or the relevant supplier without undue delay and provide a reasonable opportunity to remedy it.
9. Notices, complaints and refunds
9.1 Cancellation, amendment and complaint requests must be submitted in writing through the channels on the Support page. The Customer should retain evidence that the request was received.
9.2 Approved refunds are normally made to the original payment method. The bank or card scheme may take additional time to post the amount after MBD Travel processes it.
9.3 Rights concerning unauthorised transactions and mandatory statutory remedies remain available. To allow prompt investigation, Customers are encouraged to contact MBD Travel first with the booking number.
10. Personal data and documents
Passenger data needed to form and perform the booking may be shared, to the necessary extent, with airlines, hotels, tour operators, payment providers and competent authorities. The Privacy Policy contains further details. The agreement and booking documents will be provided by email or another durable medium.
11. Governing law and disputes
M B D TOURISM L.L.C is domiciled in Dubai and this agreement is governed by the laws of the United Arab Emirates. The parties will first seek resolution through the Support channel. The Customer retains the right to use the consumer complaint channels of the Dubai Department of Economy and Tourism and to apply to the competent Dubai courts.
12. Priority, severability and effect
12.1 The order of priority is mandatory law, written order-specific terms and this general agreement. If a provision is invalid, the remaining provisions continue in effect.
12.2 Before pressing the payment button, the Customer sees the total price, essential service information and cancellation or refund class. The agreement takes effect electronically when the Customer expressly confirms that the order entails an obligation to pay.
This general agreement must be read with the order-specific pre-contract information and rate rules. No provision constitutes a waiver of mandatory consumer rights under UAE law.
